Terms & Conditions for Pony Ride Parties

TERMS AND CONDITIONS FOR PONY PARTIES AT OUR FARM: 

To register you Pony Party Event here at the Farm, you are required to give us some information and agree to our Terms for Pony Parties at our facility. 

Please read the below terms and conditions carefully before accepting them by sending off your party registration and paying the down payment! 

 

Service requested:

You will have use of our Pony Gang Party area with seating, access to a restroom (Minors have to be attended by an adult to use the bathroom at all time!!!), electric outlets, grill (bring your own coal, please!). You also can use the riding arena for games with the kids at your party when we don't perform the pony rides in the arena. You are also aloud to explore our Farm grounds, as long as you follow our rules here and keep away from the private area of our House and other blocked off areas. 

 

Our Party area is only available by request  on Saturdays  - Starting time not earlier as  12:00 pm and ending time not later as 7:00 pm

 

 

Event Agreement:

A. Payment: A non refundable down payment from $200 has to be made to reserve our Party area for your Date and Time. This payment will be charged to automatically if you send off your party registration. 

The remaining balance becomes due on the Day of the Event as soon as you arrive at the Farm. The payment is due in cash (no checks!!!!!). If you have no cash available we will charge your card on file plus a 4% processing fee. With sending off your registration and booking our service you agree to this term.

 

B. Overtime: Pony Gang Party area is booked for the agreed time and price. Any time over this will be charged with $100 for each started hour over the agreed time. This will be added to your booking and charged to the credit/debit card on file. If your payment gets rejected or disputed the amount will stay due till paid in full including a $50 administration fee plus any additional cost to regain the declined payment. With sending off your registration and booking our service you agree to this term.

 

C. Failed Payment: You understand that this authorization for payment charges will remain in full force and effect until all open fees are paid in full. You understand that a sufficient balance and/or credit line must be maintained in your account to fulfill your obligations. You understand that insufficient funds and/or denial of payment to Pony Gang Equestrian Services will result in a $50 administration charge for each case of insufficient funds and/or denial of payment to Pony Gang Equestrian Services, which will be deducted from your Debit/credit Card on file. You will also be responsible for any legal fees in full Pony Gang Equestrian Services / Stefanie Terebayza have to pay to be able to regain the payment you own. 

 

D. Postponement: If inclement weather, heavy rain or high winds are forecast for the time that your event is scheduled, then the client has the right to postpone the event. Pony Gang Equestrian Services must be notified of the postponement at least 3 hours before the event starting time. The client can reschedule the event within 60 days of the original event date at no additional cost. If the postponement of an event is necessary, Pony Gang Equestrian Services reserves the right to substitutions of equal value on the rescheduled event date. If the postponement of the event is made less than 3 hours before the event starting time, an additional charge may be added up to a maximum of 50% (fifty percent) of the contract price . Once the event starting time is less as 1 hour way or has passed the remaining balance becomes due, and postponement of the event is no longer available. When rain is forecast for the time that the event is scheduled you have to contact Pony Gang Equestrian Services by phone to talk to a representative about your scheduled party. If the Pony Gang Equestrian Services representative recommends that the event should be postponed or cancelled and a refund of the deposit is offered to the client, but the client insists that the event be set-up anyway, and the event after that gets rained upon during the event, no refund will be given and remain balance becomes due. 

 

E. Cancellation: Cancellations can only be made based on inclement weather.  Cancellations of any other nature will be charged a cancellation fee off 60% of the event fee if cancellation is made 14 days prior to event date and with submitting the event registration client agrees to this cancellation fee. Full fee will be due if any cancellations are made less as 14 days before the event is scheduled. With submitting your event registration you agree to that the full charge will be made to your Credit/Debit Card. 

 

A direct contact by phone will need to be made if you plan on canceling or postpone. You must speak to someone in person. No answering machine, text or email messages will be accepted for cancellations or be postponing a scheduled event. If you do not observe this, the event stays on schedule, and the full balance becomes due. You lose your right to postpone the event and the agreed event charge will become due. You agree the this charge will be made to your Credit/Debit Card on file. 

 

Pony Gang Equestrian Services reserves the right to cancel services for circumstances beyond our control (Horse illness, equipment failure) and will automatically issue a refund of the deposit. 

 

 

G. Pictures: Clients give permission to use any photographs taken at the event to be used for marketing purposes. 

 

H. Pony rides: Kindly review " A word from our Ponies"  that will be send to you with your invoice with your guests before arrival at the Farm. The children and your guests will be asked to follow these simple rules for their safety, ours, and our ponies. You may wish to print a copy and include along with your party/event invites.

 

Children should be between the ages of 2- 10. If older children will attend your party/event and our pony ride we need to be informed in advance to be able to bring on of our large ponies. 

Here we will give you an overview what our ponies can carry: 

Medium sized Miniature Horse - Rain: 50 lbs (mainly used pony)

Small sized American Shetland Pony - Stella : 80 lbs 

Small sized Welsh Pony - TJ: 90 lbs 

Medium sized Dartmoor Pony - Fee: 110 lbs (mainly used ponies)

Large Pony Welsh Pony - Joey: 130 lbs

 

110 lbs is the maximum weight on regular pony ride parties/events and 130 lbs when our large pony was requested.

 

Pony rides are for children up to age of 12. NO RIDING FOR ANYONE OLDER!

 

I. Release/Waiver/Hold Harmless and Acknowledgment of Risk: These forms will be also send to you with your invoice and have to be filled out and signed by our client and each attending child's parent. Without a signed Release Form Pony Gang Equestrian Services cannot let a child ride, and no exceptions will be made. 

 

J. OSHA: Client understands South Carolina/North Carolina and Federal OSHA laws and complies with all requirements of OSHA at the location. Choice of Law: The laws of the State of South Carolina govern this agreement. If the undersigned or any of their participants files a lawsuit against Pony Gang Equestrian Services, Stefanie Terebayza, or any representative it is agreed to do so solely in the State of South Carolina. 

 

Severability: If any section of this Agreement is held to be invalid by a court of competent jurisdiction, the invalidity does not affect other sections of the agreement that can be given effect without the invalid section, and to this end the agreement is severable. 

 

K. Parents should ensure that children wash their hands after riding and petting the ponies. Parents should ensure that children do not eat until their hands are washed. Pony Gang Equestrian Services is not responsible to ensure that children wash their hands and cannot Be hold responsible for any sickness or illness that results out of not following this safety request. 

 

Warning: UNDER SOUTH CAROLINA AND NORTH CAROLINA LAW, AN EQUINE ACTIVITY SPONSOR OR EQUINE PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OR EQUINE ACTIVITIES, PURSUANT TO ARTICLE 4 CHAPTER 7 OF TITLE 47 OF THE OFFICIAL CODE OF SOUTH CAROLINA LAW.

 

With sending of the registration I acknowledge that I have read and reviewed the foregoing PONY GANG EQUESTRIAN SERVICES Agreement and Acknowledgement of Risks, and I agree to be bound by the same. 

 

TERMS AND CONDITIONS PONY RIDE PARTY ON THE ROAD

 

To register you Pony Party Event at your place , you are required to give us some information and agree to our Terms for Pony Parties at our facility. 

Please read the below terms and conditions carefully before accepting them by sending off your party registration and paying the down payment! 

 

Service requested:

2 ponies and 2 handlers for 1 hour of Pony Ride 

Our Pony Ride on the Road is only available by request  on 

Saturday 

Starting time not earlier as  12:00 pm and ending time not later as 7:00 pm 

 

Pony Ride Parties can be performed almost anywhere, such as backyards, front-yards. However, our ponies cannot perform on rocks, uneven or un-level ground, HILLS, ROADS, CONCRETE Drives or grass that has been treated with pesticides or fertilizers with 7 days of the party date.  Location cannot be on a major/busy highway, or front yard, which receives large amounts of street traffic. The area in which you would like to hold your pony party needs to be an area large enough for the ponies,  and your children, thus meaning we need additional room from the area we are working in, to allow your quests to wait ,(out of harms way). This is strictly for the safety of our ponies, our staff and your children.

We must have adequate parking close to the party location for our Truck and Trailer to park and unload the ponies safely: We can not unload our ponies on a busy highway, parking lot, hill or road which receives large amounts of street traffic. 

***Kindly advise if your street is a narrow street, with no or limited parking, or your street goes to a dead end with no cul de sac for which we can turn around in.

 

Event Agreement:

A. Payment: A non refundable down payment from $200 has to be made to reserve our ponies for your Event and Party. This payment will be charged to automatically if you send off your party registration. 

The remaining balance becomes due on the Day of the Event as soon as we arrive at your place. The payment is due in cash (no checks!!!!!). If you have no cash with you we will charge your card on file plus a 4% processing fee. With sending off your registration and booking our service you agree to this term.

 

B. Overtime: Our ponies cannot be booked for longer as 1 hour of pony rides. But you are able to book an extra ponies and handlers which will be charged with $150 pony/handler pair.

You understand that a sufficient balance and/or credit line must be maintained in your account to fulfill your obligations. You understand that insufficient funds and/or denial of payment to Pony Gang Equestrian Services will result in a $50 administration charge for each case of insufficient funds and/or denial of payment to Pony Gang Equestrian Services, which will be deducted from your Debit/credit Card on file.

Every postponement is requested 1 hour or less or once the event starting time has passed the full remaining balance becomes due, and postponement of the event is not available. When rain is forecast for the time that the event is scheduled you have to contact Pony Gang Equestrian Services to talk to representative. If the Pony Gang Equestrian Services representative recommends that the event should be postponed or cancelled and a refund of the deposit offer was given to the client, but if the client insists that the event be set-up anyway, and the event after that gets rained upon before starting time or during the event, no refund will be given and remain balance becomes due in full.

F. Theme and Color Party: Color and decoration of ponies can be requested – but are not guaranteed and may be charged with an extra fee.
